Minnesota Legalized Marijuana
On August 1, 2023, the new marijuana law takes effect in Minnesota. The new law will allow possession of up to 2 pounds of marijuana in possession in your home, or up to 2 ounces in a motor vehicle’s trunk/cargo area. The law will also permit growing up to 8 plants on your property, with some conditions. In addition to the legalization, the new law allow expungement of some old marijuana convictions.These are just some of the many changes in Minnesota law.
Because Minnesota legalized marijuana, significant changes in how we defend against criminal charges are in the works. The change in the law will likely affect when law enforcement can search motor vehicles and obtain search warrants due to the odor of marijuana. The reliability of canine sniff searches will be also questionable because most of the law enforcement canines in Minnesota have not been trained to differentiate between the odor of marijuana and other controlled substances.
